TERMS OF SERVICE

These Terms of Service (“Terms”) are a legally binding agreement between Sophia Rodionov, Osek Murshe (Licensed Dealer) / Osek Patur (sole businessperson), registration no. 311016910, located at She’erit ha-Pleta Street 39, Haifa 3491541, Israel (“the Company”, “we”, “our”, or “us”) and any person or entity (“Customer”, “you”, or “your”) who accesses, browses, uses, or purchases products or services through our website at https://courses.canotstop.com (“Website”).

Nothing in these Terms shall derogate from the provisions of any applicable law, including the Israeli Consumer Protection Law, 1981 and related regulations. In case of conflict, the law shall prevail.

By using our Website and/or completing a purchase, you acknowledge that you have read, understood, and agreed to be bound by these Terms.


1. General Provisions

  • The Website provides information about our products and services, promotions, and ways to contact us.

  • Products and services displayed on the Website can be purchased online subject to availability and these Terms.

  • We are not obligated to supply items that are not in stock or available.

  • Errors in product/service descriptions or pricing due to human or technical mistakes may occur. In such cases, the transaction will not be valid at the incorrect price, and the Customer may choose to purchase at the correct price.


2. Promotions

We may, at our discretion, offer promotions, discounts, or special deals. We reserve the right to change or cancel promotions at any time. Not all promotions necessarily apply to all Customers.


3. Eligibility and Right to Purchase

Purchases are permitted only to individuals over 18 years of age or legal entities represented by authorized persons. If you are under 18 or otherwise not legally entitled to contract without guardian approval, your purchase will not bind the Company.


4. Orders and Payments

  • To complete an order, you must provide accurate and complete details (name, contact, address, payment method).

  • Purchases require payment via valid credit card or another accepted method (e.g., PayPal).

  • Orders are valid only after approval by the relevant financial organization.

  • A confirmation email will be sent after successful payment and order approval.

  • Installment payments, if offered, are charged monthly according to agreed terms.

  • All prices include VAT unless otherwise stated. Shipping and handling are additional unless specified.


5. Delivery

  • Digital products/services: Delivered by email or through access in the Website Library after payment.

  • Physical products: Shipped via UPS (or other courier) after order confirmation. Customers may also choose local pickup if available.


6. Services

We offer digital educational services in the field of watercolor and mixed-media painting, including but not limited to:

  • Pre-recorded courses for self-paced learning

  • Live classes and their recordings

  • Mentoring programs with personalized guidance

  • Memberships and other online resources

All services are intended for personal, educational use only. Access is granted upon purchase and governed by these Terms.


7. Warranties

  • Responsibility for product quality, durability, and specifications lies with the manufacturer or guarantor (for physical goods).

  • For services and digital products, access and delivery are provided “as is” and we do not guarantee specific learning outcomes or results.


8. Cancellation, Return, and Refund Policy

8.1 Digital Services (Courses, Classes, Mentoring)

General Rule
Digital services are non-refundable once access has been provided (e.g., recordings, memberships, mentoring sessions).

Exceptions – Refunds may be approved if:

  • Duplicate purchase of the same service occurred.

  • Early-bird class purchased but not yet held and no recording provided (refund possible before class date).

  • Access was not provided due to technical error on our Website and could not be restored within a reasonable time.

Refunds, if approved, are processed to the original payment method within 14 business days. A cancellation fee of 5% of the transaction value or 100 NIS (whichever is lower) may apply.


8.2 Digital Products (Downloads, Access via Library or Email)

General Rule
Digital products are deemed delivered once access has been granted and are non-refundable, in line with Israeli law and international e-commerce standards.

Exceptions – Refunds may be granted for:

  • Duplicate purchase of the same digital product.

  • Early-bird product not yet delivered (e.g., class material scheduled for future release).

  • Technical issues preventing access, if unresolved after support.

Refund requests follow the same procedure and refund rules as above (section 8.1).


8.3 Physical Products (Prints, Shipped via UPS)

Cancellation Period

  • Customers may cancel within 14 days of purchase, receipt, or receipt of transaction details (whichever is later).

  • This period extends to 4 months for senior citizens, new repatriates, or persons with disabilities, if direct communication occurred (including electronically).

Conditions of Return

  • Products must be returned unused, undamaged, complete, and in original packaging.

  • Non-returnable: tailor-made goods, hygiene-sensitive items, consumables (e.g., bulbs, batteries, cartridges), and software/media that can be copied.

Refunds

  • Defect/discrepancy – full refund within 14 days, including shipping, no cancellation fee.

  • Other reasons – refund within 14 days minus a cancellation fee of up to 5% of the product price or 100 NIS, whichever is lower.

  • Return shipping is at the Customer’s expense unless cancellation is due to defect.

After Shipment
If cancellation occurs after dispatch, Customer must return the product at their own expense. Products showing deterioration, damage, or improper use will not be refunded.


9. Restricted Actions

You may not:

  • Use the Website or Content unlawfully or fraudulently.

  • Circumvent or interfere with Website security.

  • Copy, distribute, or commercially exploit Content without permission.

  • Provide false payment information (a criminal offense).

We may suspend or terminate your access if misuse is suspected.


10. Privacy and Data Security

  • Sensitive payment details (e.g., credit card numbers) are transmitted securely to financial institutions and not stored by us.

  • We comply with the Consumer Protection Law, 1981 and the Communications Law (Bezeq and Broadcasting), 1982 (Amendment No. 40).

  • Our Privacy Policy governs how we collect and process your personal data.


11. Limitation of Liability

We are not liable for delays, interruptions, or errors in Website operation.
We disclaim liability for indirect, incidental, or consequential damages to the fullest extent permitted by law.


12. Governing Law and Jurisdiction

These Terms shall be governed by the laws of the State of Israel. Any dispute shall be resolved exclusively in the competent courts of Tel-Aviv, Israel.
